Introduction

These Terms and Conditions constitute a legally binding agreement ("Agreement") made between you and Roamify concerning your access to and use of our website or mobile Application (the "Application"). You agree that by using the Application, you have read, understood, and agree to be bound by all of these Terms and Conditions.

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE APPLICATION AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1. eSIM Service

Roamify resells the service through partners, which sells prepaid eSIMs with data service plans based on eSIM technology (the "Service"). Roamify may resell the service through partners or an agent.

2. Terms of Service

2.1 Registration

  • The customer may register for the Service through our website and Roamify App
  • To register, the customer must provide First and Last name and verifiable email address
  • Customers may voluntarily upload profile photos and state travel preferences
  • Registration requires acceptance of these Terms and Conditions and the Privacy Policy

2.2 Purchase and Activation

  • Roamify may restrict plan availability by country
  • Customers must have an unlocked, eSIM-compatible device
  • eSIM remains on device after credit expires (can be manually removed)
  • Activation requires stable internet connection

2.3 Duration and Termination

  • Service begins after successful eSIM download and activation
  • Duration follows purchased plan terms
  • Service terminates when plan is consumed or expires
  • Roamify may suspend service for breach of terms

2.4 Engagement in Service

  • Service provided "as is" and "as available"
  • No guarantee of network coverage or quality
  • Service depends on customer's internet/network provider
  • Roamify will attempt to fix faults but makes no guarantees

2.5 Fair Use Policy

  • Unlimited data subject to Fair Use Policy (FUP)
  • FUP prevents abuse and ensures equitable access
  • Excessive or abusive usage may result in service suspension

2.6 Data Privacy

  • Usage subject to Roamify's Privacy Policy
  • Roamify may monitor usage data for service improvement

3. Payment Terms

  • Purchases available on website and Roamify App
  • All eSIMs are prepaid
  • Prices include indirect taxes unless specified

4. Returns and Refunds Policy

  • Charged upon purchase of eSIM
  • Refunds available before installation/activation or for technical issues
  • Complaints should be sent to support channels

5. Governing Law and Legal Compliance

  • Governed by laws of State of California, USA
  • Other applicable laws may apply based on location
  • May collect personal information for legal compliance

6. Intellectual Property

The Application and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Roamify and its licensors. The application is protected by copyright, trademark, and other laws.

7. Limitation of Liability

To the extent permitted by applicable law, in no event will Roamify or its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages.

Aggregate liability will not exceed the amount paid by you to Roamify in the twelve (12) months preceding the event giving rise to the liability.

8. User Generated Contributions

The Application may invite you to contribute content. Any Contributions you transmit may be treated as non-confidential and non-proprietary. When you create or make available any Contributions, you thereby represent and warrant that:

  • Your Contributions do not infringe third-party rights
  • You have necessary rights and permissions
  • You have consent for any identifiable persons
  • Your Contributions are not false or misleading
  • Your Contributions are not unsolicited advertising
  • Your Contributions are not obscene or objectionable
  • Your Contributions comply with all applicable laws

Violation of these terms may result in termination of your rights to use the Application.

9. Contribution License

By posting Contributions, you grant Roamify an unrestricted, worldwide license to use your Contributions for any purpose. You retain ownership but waive moral rights.

Roamify has the right to edit, re-categorize, or delete any Contributions at any time without notice.

10. Changes and Amendments

We reserve the right to modify this Agreement at any time, effective upon posting an updated version. Continued use after changes constitutes your consent.
